Terms and Conditions

1) Scope of Application
1.1 These General Terms and Conditions of PIKA fresh GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller via the online shop at www.pika-kitchen.com.
1.2 The online shop is primarily aimed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. An entrepreneur is a natural or legal person acting in the exercise of their commercial or independent professional activity.
2) Conclusion of Contract & Customer Account
2.1 The product descriptions in the online shop do not constitute binding offers. All goods are sold only in household quantities.
2.2 The Customer may submit a binding offer by clicking the "Order with obligation to pay" button. A contract is only concluded upon dispatch of the goods and receipt of the shipping confirmation by e-mail.
2.3 For instant payment methods (PayPal, Shopify Payments, Amazon Payments), the contract is concluded upon clicking the confirmation button.
2.4 The Customer may create a customer account. They are obliged to protect their login data from third-party access and to ensure that the profile data is correct.
3) Right of Withdrawal & Voluntary Returns
3.1 Consumers are entitled to a statutory 14-day right of withdrawal. Please refer to the separate cancellation policy for details.
3.2 The Customer shall bear the costs of the return shipment, unless otherwise agreed in the context of special promotions.
4) Prices and Payment Terms
4.1 Prices are total prices including statutory VAT.
4.2 For deliveries outside the EU (e.g. UK), the Customer shall bear any applicable customs duties, taxes or fees.
4.3 Payments are processed via Shopify Payments (credit card, Stripe), Klarna or PayPal. The charge is made immediately or after invoicing, depending on the payment method selected.
5) Delivery and Shipping Terms
5.1 Delivery is made to the address specified by the Customer. Collection is not possible for logistical reasons.
5.2 The delivery time within Germany is usually 3-5 working days.
5.3 Transfer of risk: For consumers, the risk of accidental loss passes upon handover of the goods. For entrepreneurs, the risk passes to the Customer upon handover to the carrier/freight forwarder.
6) Retention of Title
The delivered goods remain the property of PIKA fresh GmbH until full payment of the purchase price.
7) Liability for Defects (Warranty)
7.1 The statutory provisions apply.
7.2 Natural materials: Minor variations in colour or texture may occur with glass products or specific stainless steel finishes. These do not constitute a defect, provided they do not affect functionality.
7.3 For entrepreneurs, the limitation period for defect claims for new goods is one year from delivery.
8) Special Conditions for Personalisation (e.g. Engraving)
If the Seller owes processing according to the Customer's specifications (e.g. engraving), the Customer must provide the content (texts, logos) in the correct format. The right of withdrawal is excluded for personalised goods pursuant to Section 312g (2) No. 1 BGB (German Civil Code).
9) Liability
The Seller is fully liable for intent, gross negligence and injury to life, body or health. In cases of simple negligence, liability is limited to the foreseeable damage typical for this type of contract.
10) Vouchers
Promotional vouchers (free of charge) and gift vouchers (purchased) can only be redeemed in the online shop. Gift vouchers can be redeemed until the end of the third year after purchase. Cash payment is excluded.
11) Applicable Law & Jurisdiction
11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
11.2 If the Customer is a merchant, the exclusive place of jurisdiction is the registered office of PIKA fresh GmbH (Frankfurt am Main/Eschborn).
12) Dispute Resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
